WATEROPS BETA TERMS:
Effective date: 9 October 2026
These Beta Terms apply to your access to and use of WaterOps, provided by SustainCO Pty Ltd (“SustainCO”, “we”, “us” or “our”).
By creating an account, selecting the agreement checkbox or using WaterOps, you agree to these terms and our Privacy Policy.
1: Beta service
WaterOps is currently provided as a beta service for testing, evaluation and improvement. Some functions may be incomplete, changed, suspended or removed while the service is being developed.
Beta access is currently provided free of charge. SustainCO will not charge you automatically. If paid plans are introduced, pricing and applicable terms will be presented to you before you purchase or activate a paid plan.

2: Purpose of WaterOps
WaterOps is a calculation and decision-support tool intended to assist suitably experienced users with water-treatment assessments.
Results depend on the information entered, assumptions selected, calculation methods used and the limitations of the available data. Outputs may contain errors or may not account for all site-specific conditions.
WaterOps does not replace:
• qualified engineering or water-treatment advice;
• laboratory testing and verification;
• site inspections and risk assessments;
• equipment manufacturer requirements;
• workplace health and safety procedures;
• environmental approvals, discharge limits or regulatory obligations; or
• professional judgement by a suitably competent person.
You must independently check all inputs, calculations and recommendations before acting on them.
Do not use WaterOps as the sole basis for chemical dosing, equipment selection, process changes, environmental discharge, safety-critical decisions or regulatory compliance.
3: Your account
You must provide accurate and current signup information.
You are responsible for:
• protecting your password and account credentials;
• activity performed through your account;
• preventing unauthorised access; and
• notifying SustainCO promptly if you suspect that your account has been compromised.
Accounts must not be shared between unrelated users unless SustainCO has expressly approved the arrangement.
4: Acceptable use
You may use WaterOps for legitimate internal business, technical, educational and evaluation purposes.
You must not:
• use WaterOps unlawfully, fraudulently or in a way that may cause harm;
• attempt to bypass account, access or data-security controls;
• access or attempt to access another member’s projects or information;
• introduce malicious code or interfere with the service;
• scrape, copy, reverse engineer or reproduce the service except where permitted by law;
• resell or commercially redistribute WaterOps without written permission; or
• use WaterOps to misrepresent unverified results as certified engineering advice.
5: Project information and user content
You retain ownership of the project information and other content you enter into WaterOps.

You give SustainCO permission to host, process, store, back up and transmit that information to the extent reasonably required to:
• provide WaterOps;
• save and retrieve your projects;
• secure and troubleshoot the service;
• maintain audit records;
• improve calculations and usability; and
• meet legal obligations.

SustainCO may use aggregated or de-identified information to analyse and improve WaterOps, provided it does not reasonably identify you, your customer or a specific facility.
Do not enter information that you are not authorised to provide, including confidential information belonging to another person or organisation.

6: Data isolation and security
WaterOps is designed so authenticated members can access only projects associated with their own account, except where authorised administrative access is required for support, security, legal compliance or investigation.
We use reasonable safeguards, but no online system can be guaranteed to be completely secure or continuously available. You should retain copies of information and reports that are important to your operations.

7: Intellectual property
WaterOps, including its software, interface, calculations, content, branding and supporting material, is owned by or licensed to SustainCO and is protected by applicable intellectual-property laws.
These terms give you a limited, non-exclusive, non-transferable and revocable right to use WaterOps in accordance with these terms. No ownership rights are transferred to you.

8: Feedback
If you provide suggestions, test results or other feedback about WaterOps, SustainCO may use that feedback to develop and improve its products and services without an obligation to compensate you.
We will not intentionally identify you publicly as the source without your permission.

9: Availability and changes
We may update, restrict, suspend or discontinue any beta feature where reasonably necessary for development, maintenance, security, legal compliance or service operation.
We do not guarantee that WaterOps will be uninterrupted, error-free or compatible with every browser, device or operating environment.

10: Suspension or termination
We may suspend or terminate access where:
• these terms are breached;
• an account creates a security or operational risk;
• unlawful or abusive activity is suspected;
• continued access could harm SustainCO, another user or a third party; or
• WaterOps or the beta program is discontinued.
You may stop using WaterOps at any time.

11: Consumer rights
Nothing in these terms excludes, restricts or modifies any right, guarantee or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.

12: Limitation of liability
To the maximum extent permitted by law, SustainCO is not liable for indirect or consequential loss arising from use of the beta service, including loss of profit, revenue, production, opportunity, anticipated savings or data.
Where liability cannot lawfully be excluded but may be limited, SustainCO’s liability is limited, at its option and where permitted by law, to supplying the affected service again or paying the reasonable cost of having it supplied again.
These limitations do not apply where liability cannot legally be limited or excluded.

13: Changes to these terms
We may update these terms as WaterOps develops. If a material change affects existing members, we will take reasonable steps to provide notice.
Continued use after an updated version takes effect constitutes acceptance of the updated terms. Where fresh consent is legally required, we will request it.

14: Governing law
These terms are governed by the laws of New South Wales, Australia. The parties submit to the courts of New South Wales and courts entitled to hear appeals from them.
